Imafuji. (hereinafter referred to as the “Website”) and Aoyama Civil Engineering Co., Ltd. (hereinafter referred to as the “Company”) have established the Terms of Use (hereinafter referred to as the “Terms”) to ensure that customers can comfortably use the Website and Imafuji website operated by the Company.
Article 1 (Purpose)
The Terms of Use shall apply to any and all relationships between the Users of the Service (hereinafter referred to as the “Users”) and the Company, with respect to the various contents provided by the Company in the Service (hereinafter collectively referred to as the “Contents”).
Article 2 (Applicability)
Users of the Contents shall fully comply with all terms and conditions, including but not limited to the Terms of Use and the terms and conditions independently stipulated for each individual service. Users may not use the Contents if they do not agree to all of the terms and conditions, including the Terms of Use and the terms and conditions independently stipulated for individual services. By using the Contents, users shall be deemed to have agreed to all terms and conditions, including the Terms of Use and the Terms of Use independently stipulated for each individual service. A user shall be a person capable of acting independently and validly in a legal capacity.
Article 3 (No Warranty)
While every effort has been made to ensure the accuracy of the Contents, the Company does not guarantee the accuracy of the Contents. In addition, the Company shall not be liable for any damages incurred by users or third parties as a result of the use of the Contents (including cases incidental to such use), whether in law or in fact, including liability for compensation for damages or business losses. The Company does not guarantee the operation of any equipment or software used by users to use the Service.
Article 4 (Attribution of Rights)
All copyrights and other intellectual property rights pertaining to text, images, logos, programs, illustrations, site design, and other works posted on the Service belong to the Company. Users may not use these copyrighted works without the prior written consent of the Company, except as otherwise provided in the Terms of Use or in the terms of use independently stipulated for individual services.
Article 5 (Prohibited Matters)
Users shall not engage in any of the following acts in connection with the use of the Service.
- Acts that violate or may violate laws and regulations
- Fraudulent or threatening acts against the Company, users of the Service, or other third parties
- Any act that infringes or may infringe on the copyrights, trademarks, or other intellectual property rights, privacy rights, portrait rights, or other rights of the Company or any third party
- Interfering with the operation of the Website, such as transmitting harmful computer programs, etc
- Transferring, lending, or granting a security interest in the rights held by a user to a third party
- Acts of acquiring and using information in the Service by using anything other than a browser or RSS reader
- Any act of reproduction, sale, publication, or any other use of the Contents beyond the scope of personal use without the Company’s approval
- Falsifying information made available through the Contents
- Use of the Contents by impersonating another person
- Publication or posting of information offensive to public order and morals (including, but not limited to, obscene or violent message graphics, sounds, etc.) on bulletin boards, etc. provided by the Company
- Posting for advertising/promotional purposes or affiliate marketing purposes (including posting for advertising/promotional purposes or affiliate marketing purposes when a user is directed to a site outside of Facebook or Twitter)
- Religious activities or solicitation to religious organizations, act for the purpose of meeting and unfamiliar members of the opposite sex, acts of displaying information equivalent to child pornography and/or child abuse.
- Acts that fall under the misconduct or prohibited acts stipulated by SNS operators
- Providing benefits to antisocial forces, etc
- Any act that encourages any of the above acts (including cases where a third party is engaged in these acts)
- Other activities that the Company deems inappropriate
Article 6 (Suspension of Use by the Company)
If any of the following cases applies to a user, the Company may delete or hide the posted data on the bulletin board and suspend the use of Service.
- If a user’s act falls under any of the prohibited acts set forth in the preceding article
- In the event that users do not follow instructions or guidance from the Company required for the use of the Contents
- Other cases in which the Company deems you to be unsuitable as a user
Article 7 (Compensation for Damages)
If a user causes damage to a third party through an act in violation of the Terms of Use or through the illegal use of the Contents, such user shall resolve the issue at his/her own responsibility and expense and shall not cause any damage to the Company. If a user causes damage to the Company by violating the Terms of Use, the Company may make a reasonable claim for damages against such user.
Article 8 (Personal Information Protection)
- All personal user information the Company has obtained will be handled in accordance with the Privacy Policy on this Service.
- The Company may disclose a part of the user’s IP address information, etc. to a third party without the user’s individual consent for the purpose of advertising and promotional activities and production of statistical data for the Service. However, the Company shall obtain the prior consent of an individual user for the disclosure of personal information (name, address, and e-mail address) that can identify a specific individual. The same shall apply even after the user has terminated use of the Contents.
Article 9 (Suspension of Service)
The Company may temporarily suspend the Service without prior notice to users if any of the following events occurs.
- In case of periodic or emergency maintenance of the system related to the Service
- When the telecommunication line for the Service is unavailable due to reasons attributable to Type I Telecommunications Carriers
- In the event that the Service becomes unavailable due to fire, power failure, or force majeure such as earthquake, eruption, flood, tsunami, etc
- In any other cases where the Company deems it necessary to temporarily suspend the Service for operational or technical reasons
Article 10 (Termination of Service)
The Company may terminate the Contents upon prior notice to users on the Service, and all users shall be deemed to have consented to such termination at the time such notice is posted on the Service.
Article 11 (Disclaimer)
The Company shall not be liable for any damages incurred by users or third parties in connection with the interruption, delay, modification, or termination of the Service or use of the Contents, except in cases of intentional or gross negligence on the part of the Company. If the user is a consumer as defined in the Consumer Contract Act, the disclaimer in the preceding paragraph shall not apply. In such a case, except in the case of intentional or gross negligence on the part of the Company, the Company shall not be liable for damages beyond the scope of damages that could normally arise and in excess of 10,000 yen.
Article 12 (Modification of Terms of Use)

The Company may, at our discretion, modify the Terms of Use without obtaining individual user consent in the following cases
- When the Company finds that modifying the Terms of Use conforms to the common interests of the Users
- If the modification of the Terms of Use does not conflict with the purpose of the Agreement and is reasonable in light of the necessity of the modification, the reasonableness of the modified contents, the details of the modification, and other circumstances pertaining to the modification.
- When making changes to the Terms of Use as stipulated in the preceding paragraph, the Company shall notify users of the change of the Terms of Use as well as the content and effective date of the amended Terms of Use at least two weeks prior to the effective date of the amended Terms of Use.
- When a user uses the Service after the effective date of the revised Terms of Use, the user is deemed to have agreed to the revised Terms of Use.
Article 13 (Severability)
Even if any provision of the Terms of Use or any part thereof is determined to be invalid or unenforceable under the Consumer Contract Act or other laws or regulations, other provisions of the Terms of Use and the remainder of any provision that is determined to be invalid or unenforceable in part shall remain in full force and effect.
Article 14 (Governing Law)
The laws of Japan shall apply to the formation, effect, performance, and interpretation of the Terms of Use.
Article 15 (Agreed Jurisdiction)
The Tokyo District Court shall have exclusive jurisdiction of the first instance over any disputes related to the Service, the use of the Content, or lawsuits concerning the Terms of Use.
